Our business is clear and transparent. Here’s how we work:

All references to Lady Bonin’s Tea (Pty) Ltd. trading as “Lady Bonin’s Tea”, “Provider”, “the Company”, “we”, “us” and “our” in these terms and conditions are deemed to refer to ‘Your Company Name Pty Ltd’, registration number 2016/051342/07, Income Tax Registration No. 9510825160, a limited liability private company incorporated in the Republic of South Africa. All references to “you” and “your” are deemed to refer to any user and/or visitor of www.ladyboninstea.com (“Website”).

These Terms and Conditions (“the Terms and Conditions”) govern your use of the website located at the domain name www.ladyboninstea.com. By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.

Electronic Communications

By using this Website or communicating with the Provider by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.

E-Commerce & Privacy

The Website sells coffee and coffee accessories online. The use of any product bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.

The Provider undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Copyright and Intellectual Property Rights

Provider provides certain information on the Website. Content currently or anticipated to be displayed at this Website is provided by Provider, its affiliates and/or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“the Content”). Limited License to General Users

Provider grants to the User, subject to the further terms of these Terms and Conditions, a non-exclusive, non-transferable, limited and revocable right to access, display, use, download and otherwise copy the current and future Content for personal, non-commercial and information purposes only.

This Website and the Content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of Provider. The license does not allow the User to collect product or service listings, descriptions or other information displayed here, and does not allow any derivative use of this Website or the Content for the benefit of another merchant. Privacy: casual surfing

The User may visit the Website without providing any personal information. This information is aggregated to measure the number of visits, average time spent at the Website, pages viewed, etc. The Provider uses this information to determine use of the Website, and to improve content thereon. Provider assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation. Choice of Law

This Website is controlled, operated and administered by Provider from its offices within the Republic of South Africa. Access to the Website from territories or countries where the content or purchase of the products sold on the Website is illegal is prohibited. The User may not use this Website in violation of South African export laws and regulations. If the User accesses this Website from locations outside of South Africa, that User is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Cape Town High Court in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between the Provider and the User with regard to the use of the Content and this Website.

Terms and Conditions of Sales

When making a purchase with us legal obligations arise and your right to a refund charged to your credit card or paid in any other way agreed by us, are limited by our Terms and Conditions.

Once payment is made, it is deemed that you have read and understood the Terms and Conditions for such purchase so don’t make apurchase through this site unless you understand and agree to all the Terms and Conditions. Payment Options and Pricing

All transactions will be processed in South African Rands (ZAR). We aim to offer competitive prices on all of our products. Your total order price will include the price of the purchase plus any applicable sales tax (VAT) and shipping charges (on the day of shipping).

We reserve the right to change pricing at any time without prior notice.

Payment Options

Payment may be made via Visa, MasterCard, Diners or American Express credit cards or by bank transfer into The Provider’s bank account, the details of which will be provided after checkout.

Credit card acquiring and security

Credit card transactions will be acquired for The Provider via approved payment gateways. Our payment gateways use the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website.

Customer details separate from card details

We take security seriously and your Customer details will be stored by The Provider separately from card details.

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).

Delivery policy

All our tea is hand blended to order and then shipped straight to you as soon as possible for maximum freshness.

Order Processing

Your order will be dispatched once payment is validated/received (for EFT’s this means that we cannot process the order until the funds have cleared in our account which is usually the next business day). Should stock be available, orders will be dispatched the same day that payment is validated/received.

Should a product be unavailable for any reason, we will contact you directly with a delivery time estimate. In the event of unforeseen circumstances which may cause delays we will contact you directly with a revised delivery schedule.

Local Shipping

For orders within major cities in South Africa we use a courier service. Please allow 3 to 5 working days from receipt of payment to receive your order. Please ensure the correct shipping address is provided from the outset as title and risk will pass to you once the order has left our premises.

Undelivered Packages

In the case of a package being returned to us as undeliverable, we will make every attempt to contact you to make arrangements for re-shipment. We cannot be held responsible for undelivered products due to the gross negligence of the customer.

International Shipping

We love for our tea to travel as far afield as possible and are happy to do everything in our power to accommodate International orders. However transport costs can sometimes be costly so please contact us directly at www.ladyboninstea.com or +27 (0) 21  447 1741 so we can discuss the best way to get your order to you, should our existing courier options calculated on check out not be viable.

Cancelling orders

Due to the nature of the product being food based, and our food and safety systems under ISO22000, if you change your mind after shipment of order has occurred you are not entitled to cancel any sale concluded on this Website after dispatch or date of receipt of the goods. In such an event of changing your mind and wanting to cancel the order, this must be done within 2 working days of fulfilling the order and payment date. In this event:

If your order delivery is delayed for more than 7 days from the stipulated delivery date (or where none is specified, beyond 30 days from the order date) you are also entitled to cancel your order. Please read the Return Policy for further details.

Returns / Refund Policy

Unfortunately no matter how hard we try we are not machines so mistakes can happen. So if on receiving your order you find you’re your goods are damaged or if the product supplied is not the same product as what was ordered we will gladly provide you with a replacement or refund as long as you return the goods to us unopened and unused in their original packaging. Terms for damaged goods are as follows:

If the Goods have been approved for return we will notify you and either arrange for our couriers to collect the item from you OR request that you post it back to us OR ask you to return the item to our store location (dependent on the individual circumstances and original order’s shipping method) within 14 days.

Should you need to post the Goods to us please be sure to use our postal address (available above under ‘Contact Information’) and please package the goods carefully so that they do not become damaged en route. Please include a copy of your original invoice with any return.

Once your returned product has been received at our store we will endeavour to make sure your refund is back in your account within 7 days.

Responsibility

The Provider takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
